Terms of Use

These terms cover the macOS app Audio Capture, Sound Recorder ("the app") and the website audiocapture.app, both provided by Stanislav Duplinskiy ("we", "us"). Installing or using the app means you accept them.
Licence
We grant you a personal, non-transferable, non-exclusive licence to use the app on Apple devices that you own or control, as permitted by the App Store Terms of Service.
You may not copy, redistribute, sell, rent, sublicense, decompile or reverse engineer the app, or remove any proprietary notices from it, except where such restrictions are prohibited by applicable law.
Subscriptions, billing and renewal
The app is free to download. Unlimited recording requires an auto-renewing subscription, offered as Weekly Access, a 3-month plan, and an Annual plan.
All subscriptions are sold and billed by Apple through your Apple Account. Payment is charged on confirmation of purchase.
Subscriptions renew automatically at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of that period.
Where a plan includes a free trial, any unused portion of the trial is forfeited when you purchase a subscription. Cancelling during a trial prevents a charge; access continues until the trial expires.
Manage or cancel your subscription in your Apple Account settings. Deleting the app does not cancel a subscription.
Prices are set per App Store storefront and may change. Where a price increase requires it, Apple will ask for your consent before the next renewal.
Refunds
Because Apple is the seller of record, refunds are issued by Apple under its own policies, and we are not able to grant them ourselves.
Request a refund at reportaproblem.apple.com. If something in the app caused the problem, tell us as well — we would like the chance to fix it.
Acceptable use
You are responsible for what you record and for having the right to record it.
Recording conversations without the consent of the participants is illegal in many jurisdictions, and the rules differ by country and by state. Check the law that applies to you before recording other people.
You may not use the app to infringe copyright, to circumvent technical protection measures, or to capture content you are not entitled to capture. macOS itself blocks capture of protected audio, and we do not provide any way around that.
Your recordings
Recordings you make with the app are yours. They are written to your Mac and are never transmitted to us — we claim no rights over them and have no access to them.
Because your files exist only on your own machine, keeping backups of anything important is your responsibility.
Availability and changes
We may update the app, change or remove features, or discontinue it. Where a change materially reduces what a paid subscription provides, we will say so in the release notes.
The app depends on capabilities provided by macOS. Changes made by Apple to the operating system may affect how the app behaves, and are outside our control.
Disclaimer of warranties
The app and the website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
We do not warrant that every audio source on every Mac will record successfully, or that a given recording will be usable for your purpose. Test the app on the material that matters to you before relying on it.
Nothing here excludes any warranty or right that cannot lawfully be excluded, including statutory consumer rights.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or a recording that failed, was incomplete, or was lost.
Where liability cannot be excluded, our total liability is limited to the amount you paid for the app in the twelve months before the claim arose.
Termination
You may stop using the app at any time by deleting it — cancel your subscription separately in your Apple Account settings.
We may terminate this licence if you materially breach these terms. On termination, you must stop using the app; recordings already on your Mac remain yours.
Governing law
These terms are governed by the laws of the developer's country of residence, without regard to conflict of law rules. If you are a consumer, this does not deprive you of the protection of mandatory consumer law in the country where you live, and you may bring proceedings there.
Changes to these terms
We may revise these terms. The date at the top of this page shows the current version, and continuing to use the app after a change means you accept the revised terms.
